Our Privacy Policy explains how Cayuga Movement (“CM”) and its Affiliates and subsidiaries collect, store, use, disclose, and otherwise process information about you in the course of our business, including through our websites that link to this notice (such as cayugamovement.com) and our marketing and sales activities (collectively, our “Services”). It also sets out important information about your privacy rights.

1. Personal Information We Collect

  1. We collect information that alone or in combination with other information in our possession could be used to identify you (“Personal Information”) as follows:

    a. Personal Information You Provide: We may collect Personal Information if you use our Services or communicate with us. 

    b. Communication Information: If you communicate with us, we may collect your name, contact information, and the contents of any messages you send (“Communication Information”).

    c. Payment information: When you purchase or subscribe to our Services, we may collect your billing information, such as your credit card number, expiration date, and billing address, or use a third-party payment processor to process your payments (“Payment Information”).

    d. Personal Information We Collect Through Our Social Media Pages: We post on social media sites like YouTube, LinkedIn, and X (“Social Media Pages”). When you interact with our Social Media Pages, we will collect the Personal Information you elect to provide us, such as your contact details (“Social Information”). In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding our use.

    f. Personal Information We Receive Automatically From Your Use of our Services: 

      • When you visit, use, and interact with our Services, we may receive certain information about your visit, use, or interactions (“Technical Information”), including the following:

        • Log data: Information your browser automatically sends whenever you visit the Site (“Log Data”). Log Data includes your Internet Protocol address, browser type and settings, the date and time of your request, and how you interacted with the Site.

        • Usage data: We may automatically collect information about your use of our Services, such as the types of content that you view or engage with, the features you use and the actions you take, your time zone, country, the dates and times of access, user agent and version, type of computer or mobile device, computer connection, IP address, and the like.

In addition to the cookies used by CM and our service providers, some cookies are placed by third parties such as Google (for analytics, described below).         • Essential Cookies: These are essential to enable you to move around the website and use its features, such as accessing secure areas. 

    1. Performance and Analytics Cookies: These include Google Analytics, which tracks the pages you visit and the content you access so we can determine which content is most popular and improve our website's performance. These cookies primarily record aggregate and anonymous statistical data but capture minimal identifiable information, such as order IDs.

    2. Functional Cookies remember your choices, such as language options or the region you are in. These cookies help make your visit more personal and are deleted when you close your browser or the session expires.

6. Online Tracking and Do Not Track Signals: Our website currently does not respond to “Do Not Track” (“DNT”) signals and operates as described in this Privacy Policy whether or not a DNT signal is received.

2. How We Use Personal Information.

  1. We do not sell your Personal Information.

  2. We may use Personal Information for the following purposes:

    a. To provide, administer, maintain, improve, and analyze the Services;

    b. To provide you with support services; 

    c. To communicate with you, including by discussing with you options to use the CM services;

    d. To develop new features and services;

    e. To prevent fraud, criminal activity, or misuse of our services and to ensure the security of our IT systems, architecture, and networks; and

    f. To comply with legal obligations and process and protect our rights, privacy, safety, property, and that of our Affiliates, you, or other third parties.

  3. Aggregated Information: We may aggregate Personal Information and use the aggregated information to analyze the effectiveness of our Services and improve and add features to them. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics with third parties, publish such aggregated information, or make such aggregated information generally available. 

3. Disclosure Of Personal Information.

  1. In certain circumstances, we may share your Personal Information with third parties without further notice to you, unless required by the law, including without limitation in the situations below:

    a. Vendors, Service Providers, and Subprocessors: To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Information with vendors, service providers, and subprocessors, including providers of hosting services, cloud service providers, and other information technology services providers, event management services, email communication software and email newsletter services, advertising and marketing services, and web analytics services. Under our instructions, these parties will access, process, or store Personal Information while performing their duties to us.     b. Business Transfers: If we are involved in strategic transactions, reorganizations, bankruptcy, receiverships, or service transitions to another provider (collectively a “Transaction”), your Personal Information and other information may be shared in the diligence process with counterparties and others assisting with the Transaction and transferred to a successor or Affiliate as part of that transaction along with other assets.

    c. Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Services, or the public, or (v) protect against legal liability.

    d. Affiliates: We may share Personal Information with our “Affiliates,” meaning an entity that controls, is controlled by or is under common control with CM. Our Affiliates may use the Personal Information we share in a manner consistent with this Privacy Policy.

    e. Other Users: specific actions you take may be visible to other users of our services.

4. Request For Action.

  1. Please contact us to request access, deletion, rectification, restriction, or portability of your Personal Information. We reserve the right to facilitate such requests only as required by applicable law.

  2. To protect your Personal Information from unauthorized access, deletion, rectification, or restriction, we may require you to verify your identity before we process any request to know or delete Personal Information. If we cannot verify your identity (and, where applicable, proof of residency) to our satisfaction, we will not provide or delete your Personal Information.

  3. You may submit a request to learn or delete your personal information through an authorized agent. Such an agent must present signed written authority to act on your behalf and must be able to verify your identity (and, where applicable, proof of residency) to our satisfaction.

  4. We will not discriminate against you for making any such request.

5. Security. We take reasonable and appropriate steps to protect your Personal Information to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. We use appropriate technical and organizational measures to protect your personal information, including physical access controls, encryption, intrusion detection, and network monitoring, depending on the nature of the information and the scope of processing. Our staff who may have access to your information are required to keep that information confidential.

6. Data Retention And Deletion. We retain your personal information for as long as necessary to fulfill the purposes we collected it unless a more extended retention period is required or permitted by law. We may also retain your personal information for legitimate business interests, such as complying with our legal obligations, resolving disputes, and maintaining our records. When we no longer need your Personal Information, we will delete it or anonymize it by our data retention policies and applicable laws, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible. 

7. Right to Correct. If you believe any Personal Information we hold about you is inaccurate, incomplete, or outdated, you can request its correction. To request a correction, please contact us using the contact details provided at the end of this Privacy Policy. We will review your request and, where applicable, make the necessary corrections.

8. Confidentiality of Client Information

  1. Definition: "Confidential Information" means any non-public information disclosed by the Client to CM, including but not limited to personal data, health records, financial information, and any other information marked or identified as confidential at the time of disclosure.

  2. Obligations: CM agrees to maintain the confidentiality of all Client Confidential Information and to use such information solely to provide the Services. CM shall not disclose Client Confidential Information to any third party without the Client's prior written consent, except as required by law.

  3. Security Measures: CM shall implement reasonable security measures to protect Client Confidential Information from unauthorized access, use, or disclosure. These measures shall include, but are not limited to, secure storage, encryption, and access controls.

  4. Exceptions: The obligations of confidentiality shall not apply to information that (a) is or becomes publicly available through no fault of CM, (b) is received from a third party without breach of any confidentiality obligation, (c) is independently developed by CM without use of or reference to Client Confidential Information, or (d) is required to be disclosed by law or court order, provided that CM gives the Client prompt notice of such requirement to allow the Client to seek a protective order or other appropriate remedy.

  5. Removal of Content Posted by Minors: If you are a registered user of our services under 18 and residing in California, you have the right to request the removal of any content or information you have posted publicly on our services. We do not knowingly collect Personal Information from minors under 16 without obtaining parental consent. If you are a parent or guardian and believe your child has provided us with Personal Information without your consent, please contact us as detailed below, and we will take steps to remove such information. To request the removal of public posts, please send a detailed description of the specific content to be removed. Please note that content removal does not ensure complete or comprehensive removal from our systems or third-party sites that may have copied or reposted the content. We may also be required by law to maintain certain information that is not subject to deletion.

9. Links To Other Websites. Our Services may contain links to other websites not operated or controlled by CM, including social media services (“Third Party Sites”). The specific privacy policies will govern the information you share with Third Party Sites and terms of service of the Third Party Sites and not by this Privacy Policy. Providing these links does not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites for information on their privacy practices and policies.

10. International Users.

  1. Data Transfers: By using our Services governed by this Privacy Policy, you understand and acknowledge that your Personal Information will be transferred from your location to our facilities and servers in the United States and possibly from your location to other countries where our service providers operate.

  2. Privacy frameworks: We employ appropriate safeguards for cross-border transfers of Personal Information, including compliance with specific privacy frameworks relating to data transfer. For example, we comply with the European Commission's, UK's, and Swiss adequacy decisions.

11. Changes To Our Privacy Policy. We may update this Privacy Policy from time to time. When we do, we will post an updated version on this page unless applicable law or contractual agreement requires another type of notice. By continuing to use our service and providing us with personal information after we have posted an updated privacy policy or notified you by other means, you consent to the revised privacy policy.
